Terms of Service

These terms are the agreement between you and WhisperCall AI ("we", "us") for the use of whispercallai.com and the voice-call service on it. By creating an account or starting a call you accept them.

1. Who may use the service

You must be at least 18 years old and old enough to view adult content where you live. You must not use the service from a place where it is unlawful to do so. If you do not meet these conditions, do not use the site.

2. What the service is

WhisperCall AI lets you hold live voice conversations with fictional characters generated by artificial intelligence. Nothing you hear is said by a real person. The characters have no memory of you between calls, no feelings, and no knowledge of the world beyond what the model was trained on. The service is entertainment for adults. It is not a source of medical, legal, financial or safety advice and it is not an emergency service. If you are in danger, call your local emergency number.

3. Your account

Sign up with an email address you control and keep your password private. You are responsible for everything done through your account.
One account per person. Do not share, sell or transfer accounts.
Tell us straight away if you think someone else has used your account.

4. Free minutes and paid packs

Every new account receives free call time (currently 3 minutes; some promotions grant more). The free minutes are granted once per person; we check the device and network you sign up from, and repeat sign-ups start at zero.
After that, call time is prepaid in minute packs priced in US dollars and paid in cryptocurrency through NOWPayments. The coin amount is fixed at the moment you create the invoice; blockchain fees are yours.
Call time is deducted per second while a call is connected. A call ends automatically when your balance runs out.
Purchased minutes do not expire. They have no cash value, cannot be transferred to another account, and cannot be exchanged for money.
Crypto payments cannot be reversed, so purchases are final, except where consumer law gives you a right of withdrawal, or where a confirmed payment was not credited to your account. In that case contact us with the invoice id and we will fix it.
Pack prices may change. Minutes you already bought are not affected.

5. Acceptable use

The Content Policy describes what may and may not be said on a call and is part of these terms. In addition, you must not:

use bots, scripts or automation to make calls, create accounts or claim free minutes;
probe, scrape, reverse-engineer or interfere with the service or its providers;
attempt to access other people's accounts or data;
resell access to the service.

6. Content and the AI

The characters are fictional and their replies are generated on the fly. Despite safeguards, an AI can say things that are inaccurate, offensive or inappropriate. We do not endorse anything a character says. What you say on a call belongs to you and is not stored by us; see the Privacy Policy for what is kept. We may use aggregated, non-identifying usage statistics to improve the service.

7. Availability

The service is provided as it is, without a guarantee of uninterrupted operation. Calls can drop, voices can change, and features can be added or removed. If a call fails because of a fault on our side, the seconds charged for that call are refunded to your balance on request. If we ever discontinue the service, we will give notice on the site and refund unused paid minutes.

8. Ending the agreement

You can stop using the service at any time and ask us to delete your account. We may suspend or close accounts that break these terms or the Content Policy, that appear to belong to a minor, or that are used for fraud. Unused paid minutes on an account closed for a serious breach are forfeited.

9. Intellectual property

The site, its design, the characters and their voices are ours or licensed to us. You may use the service for personal, non-commercial purposes only. You may not record and republish calls as if they were real conversations or in a way that suggests we endorse the recording.

10. Liability

To the extent the law allows, we are not liable for indirect or consequential losses arising from your use of the service, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, including your statutory consumer rights.

11. Changes to these terms

We may update these terms. The date at the top shows the current version, and material changes will be announced on the site before they apply. Continuing to use the service after that means you accept the new terms.

12. Law and disputes

These terms are governed by the law of the country in which WhisperCall AI is established, without affecting any mandatory consumer-protection rules of the country you live in. If something goes wrong, write to us first; most problems are solved by email within a couple of days.
